Where eligible, Nuethia offers a 90-day money-back guarantee, subject to the requirements, eligibility criteria, exclusions, and procedures stated in our Refund Policy.
Approved refunds will ordinarily be returned to the original payment method used for the purchase unless otherwise required or agreed.
The time required for a processed refund to appear in your account may depend on your bank, card issuer, or payment provider.
Our Refund Policy forms part of these Terms.
Nothing in these Terms or our Refund Policy is intended to exclude, restrict, or replace any refund, return, cancellation, warranty, or other consumer right that cannot legally be excluded in your jurisdiction.

Nuethia is powered by Shopify, which provides technology that enables us to operate our online store and provide the Services.
However, purchases made through our store are transactions directly between you and AS Visionaries LLC doing business as Nuethia.
Shopify is not the seller of Nuethia products and is not responsible for the products sold by Nuethia or for the performance of our obligations to you.
To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims arising solely from products purchased directly from Nuethia.

NOTHING IN THESE TERMS EXCLUDES ANY GUARANTEE, WARRANTY, CONDITION, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
SECTION 19 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AS VISIONARIES LLC, NUETHIA, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO:

YOUR USE OF OR INABILITY TO USE THE SERVICES;

YOUR PURCHASE OR USE OF A PRODUCT;

LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL;

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING ANY RIGHTS OR REMEDIES AVAILABLE TO YOU UNDER MANDATORY CONSUMER PROTECTION LAW.
SECTION 20 — INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold harmless AS Visionaries LLC, Nuethia, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:

User Content submitted by you that violates these Terms or applicable law.

To the extent permitted by applicable law, we will not be responsible for delay or failure to perform an obligation caused by events reasonably beyond our control, including natural disasters, severe weather, war, terrorism, governmental action, public health emergencies, labor disruptions, transportation interruptions, carrier failures, supply-chain disruptions, internet outages, or payment-service interruptions.
This Section does not limit any consumer rights that cannot legally be excluded.

If you are a consumer located outside Wyoming, nothing in these Terms deprives you of mandatory consumer protections or rights that apply to you under the laws of your place of residence and that cannot legally be waived by contract.
